Summary of Occupational Safety & Health

(Safety and Health Committee) Regulations 1996

1. Came in force 1st January 1997

2. A Safety and Health committee in accordance with these regulations must be formed or reorganised itself by 30th June 1997

3. The regulations apply to a work place with more than 40 employees

4. The committee:

Chairman - Employer or authorized manager

bulletSecretary - SHE Officer or appointed person
bulletRepresentatives of employer (not less than 2)
bullet

Representatives of employees (not less than 2)

5. Inaugural meeting must be convened by employer -  In the meeting, make known Safety and Health policies

6. Functions: - (see Part III of regulations)

bullet

assist in development of safety and health rules and safe systems of work;

bulletreview the effectiveness of safety and health programmes;
bulletcarry out studies on trends of accident, near-miss accident, dangerous occurrence, occupational poisoning or disease;
bulletreport to the employer of any unsafe conditions and practices together with recommendations for corrective actions;
bulletreview the safety and health policies at the place of work;
bulletHold meeting at least once in 3 months;
bulletInspect place of work at least once in 3 months;
bulletInspect place of work after any incident has occurred;
bulletConvene a meeting to discuss incident reports

7. Incident reports to be kept for a minimum of 7 years

8. Quorum of meeting - Chairman, Secretary and not less than ½ of remaining members

9. Minutes of meeting to reach every member of committee 2 weeks after the meeting

10. Minutes of meeting to be kept by employer for a minimum of 7 years

11. Penalty for non compliance is RM5,000 or 6 months imprisonment or both
